Purchase offer template for a house or an apartment

A written offer states the buyer's name, the property's address, the price offered, how long the offer stands, the conditions, then the date and signature. As soon as the seller accepts it without reservation, the sale is concluded: you can no longer back out.

The template below follows the advice published by Belgian notaries. It changes by region, because the documents the seller must give you are not the same everywhere. It does not replace a notary: have your offer checked before you sign it.

This offer is made on the condition precedent that the buyer obtains a mortgage of ........ euros, no later than ........ weeks after the offer is accepted. This condition will be included in the sale agreement. If the mortgage is refused within this period, the buyer informs the seller in writing, with proof of the refusal, and the offer lapses with no compensation owed by either party.

Before accepting this offer, the seller gives the buyer the energy performance certificate (PEB) and the extract from the soil condition database (BDES). Before the sale agreement is signed, the seller also gives the report of the electrical installation inspection and the planning information for the property.

This template does not replace a notary

This template is an aid, written from the advice published by notaries. Have your offer checked by a notary before you sign it, especially if you add conditions. An accepted offer binds you. Ask your notary whether to sign the French or the Dutch version.

What to check before you make your offer

  • Write a deadline on the offer. Without one, the offer binds you for a period nobody can set in advance.
  • If you borrow, write the mortgage condition. Notaries call four weeks a usual period.
  • Ask for the region's compulsory documents before you commit. Compulsory documents by region
  • Compare the asking price with sales in the municipality. Check whether the property is worth the price
  • Simulate your mortgage and work out the buying costs. Simulate a mortgage
  • Never pay a deposit directly to the seller. It goes through the notary's client account.
  • Do not make or accept an offer by a simple text message or email: write it down and sign it.
  • Keep a signed copy of the offer and of the acceptance.

An accepted offer is a sale

According to notaries, an offer that states the property and the price precisely and without reservation binds the person who makes it. If the seller accepts it without reservation, the sale is concluded. It can then only be undone if both buyer and seller agree. The sale agreement and then the deed at the notary put it into form afterwards.

The mortgage condition, in the offer and in the sale agreement

Notaries advise writing the mortgage condition: if the bank refuses, the sale is treated as never having existed. They also point out that an offer under a condition stays uncertain until the condition is met, and that the seller may be tempted to accept another offer meanwhile. The template therefore writes the mortgage condition and states that it will be included in the sale agreement.

Why the template changes by region

The rules for an offer are the same everywhere in Belgium. What changes are the documents the seller must hand over. Because an accepted offer makes the sale, the template asks for the main ones before the seller accepts: the PEB certificate and the soil database extract in Wallonia; the EPC, the soil certificate and, for a building from before 2001, the asbestos certificate in Flanders; the soil certificate and the PEB certificate in Brussels.
