Rent Regulation in Belgium

Rent regulation in Belgium is regionalized. Each region has its own rules regarding indexation, lease duration and rental deposit.

Renting in Belgium: a regionalized legal framework

Since the 6th State Reform (2014), residential tenancy law has been regionalized in Belgium. Each region has adopted its own legislation, with notable differences.

Lease duration

  • Main residence lease: 9 years by default in all 3 regions
  • Short-term lease: maximum 3 years, renewable once (not in Wallonia: max 3 years non-renewable)
  • The tenant can terminate at any time with 3 months' notice and a degressive compensation

Rent indexation

Annual indexation is permitted in all 3 regions, based on the health index. Brussels specificity: since 2022, indexation is limited or blocked for properties with EPC E, F and G, thus encouraging energy renovation.

Rental deposit

  • Wallonia and Brussels: maximum 2 months rent
  • Flanders: maximum 3 months rent
  • The deposit must be placed in a blocked account in the tenant's name

Lease registration

Lease registration is mandatory and free for main residence leases. The landlord has 2 months after signing to register the lease. Non-registration deprives the landlord of certain rights (short notice periods favoring the tenant).

Property inventory

An entry property inventory is mandatory in all 3 regions. It must be drawn up contradictorily (by both parties) or by an expert. The absence of an inventory is presumed in favor of the tenant (the property is deemed to have been returned in the same condition).
