Commercial leases in Belgium are governed by the law of April 30, 1951. The minimum duration is 9 years, with the tenant able to terminate at each triennial period (every 3 years) with 6 months' notice. The commercial tenant has a right to lease renewal (maximum 3 renewals of 9 years). Rent is generally linked to an index (health index or consumer price index). Fiscally, the owner is taxed on actual rents (not the CI) when the tenant is a company or uses the property professionally. Commercial leases offer greater stability than residential leases, with gross yields of 4 to 7% depending on location. The owner can reclaim the property for personal use under strict conditions with tenant compensation.
