Base deed
Founding document of a co-ownership defining the private and common parts of the building.
Full definition
The base deed is the notarial founding document of a co-ownership in Belgium, mandatory as soon as a building is divided into at least two lots belonging to different owners. It is governed by the law of June 30, 1994, amended in 2010 and 2018. The base deed contains: detailed description of the building, division into private lots and common parts, shares (tantièmes) of each lot, distribution of common charges, and description of easements between lots. It is complemented by the co-ownership regulations and internal rules. Before purchasing an apartment, it is crucial to carefully read the base deed to understand rights and obligations, foreseeable charges, and any restrictions.
